Reserving a charter or using our Service constitutes your agreement to these Terms. If you do not consent to any section of these terms, you should not use the Service.

2. Service Overview

CollectiveAccessPoint offers high-end yacht charter services, including but not restricted to:

  • Yacht rentals for the day
  • Evening cruises
  • Business getaways
  • Exclusive events
  • Charters lasting several days

Access to all services is contingent on their availability and suitable weather conditions. We maintain the right to alter or cease services without prior notice.

3. Making Reservations

3.1 Reservation Procedure

In order to reserve a charter, the following steps must be taken:

  • Attain the minimum age requirement of 18
  • Submit information that is correct and complete
  • Provide the initial payment as outlined in the reservation confirmation
  • Consent to the Terms & Conditions

3.2 Confirmation of Booking

Confirmation of your reservation happens when payment is received and we issue a written acknowledgment. We hold the authority to decline services to anyone based on our judgment.

3.3 Charter Availability

Charter availability is contingent upon the accessibility of the vessel and favorable weather conditions. Efforts will be made to oblige your requested dates and timings within reason.

4. Payment Terms

4.1 Pricing

All listed amounts are in € and cover all applicable taxes except as expressly indicated. The listed prices can be revised at any time without prior announcement.

4.2 Payment Schedule

  • A down payment which is half (50%) of the entire cost of the charter is required when making a reservation.
  • The remaining balance must be paid 48 hours before the departure of the charter.
  • Any extra costs incurred will be settled at the end of the charter service.

4.3 Payment Methods

Payments can be made using recognized credit cards, electronic bank transfers, or certified bank drafts. All payment processing is performed through secure, encrypted channels.

5. Policy on Cancellations and Refunds

5.1 Cancelling by Clients

  • If cancelled more than 72 hours prior to departure: Entire amount refunded, minus service charges
  • If cancelled between 24 to 72 hours prior to departure: 50% of the amount is refunded
  • If cancelled less than 24 hours before departure: No refund is given

5.2 Cancellations Due to Weather

Should the conditions due to weather not be safe as determined by our skipper, we propose to either:

  • Move your booking to another date without any extra fees, subject to availability
  • Offer a complete refund if it is not possible to reschedule

5.3 In Case of Mechanical Failures

Should there be technical issues with the boat you were assigned, we will strive to arrange a comparable alternative. Should we be unable to do so, you will receive a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are required to:

  • Comply with all instructions given by the crew
  • Use the safety gear provided as necessary
  • Inform the crew of any health conditions that could impact their well-being
  • Stay within the assigned areas on the vessel

6.2 Prohibited Items

The following items are not allowed on board:

  • Containers made of glass
  • Controlled substances prohibited by law
  • Guns or any form of weapons
  • Excess quantities of beverages (above what is considered moderate personal consumption)
  • Animals (except if permission is given in advance)

6.3 Conduct

Passengers must behave in a manner that is considerate of others. We maintain the authority to end a charter before its planned completion without refunding fare if passenger behavior is deemed to present a danger to safety or interferes with other passengers' experiences.

7. Liability and Insurance

7.1 Our Liability

The extent of our liability is confined to the cost paid for your charter. Our responsibilities do not extend to:

  • Injuries to the individual due to their own carelessness
  • The loss or damage of personal belongings
  • Indirect or additional damages, as well as punitive measures
  • Delays arising from inclement weather or other factors we cannot influence

7.2 Insurance Coverage

Comprehensive marine insurance that safeguards our fleet and operations is in place. It is up to the passengers to arrange their own travel and personal insurance.

7.3 Assumption of Risk

By choosing to use our charter services, you recognize the innate perils associated with maritime endeavors and accept the duty for ensuring your safety and security.

8. Modifications and Itinerary Changes

Our company maintains the authority to adjust travel plans, paths, or timetables due to considerations such as weather conditions, safety matters, or logistical necessities. We will strive to offer alternatives that are of comparable value.

9. Force Majeure

We are not responsible for any holdups, cancellations, or itinerary changes that arise from events outside our control, which include but are not limited to:

  • Extreme weather events
  • Natural calamities
  • Governmental edicts
  • Shutdowns of ports
  • Breakdowns of machinery

10. Privacy and Data Protection
